This cause came on this day to be heard (in which service of process has been personally had upon the defendant who has failed to appear, defend, plead or answer on the bill of complaint filed and exhibited herein, and depositions of witnesses taken in support thereof, and was argued by counsel. On consideration whereof it appearing to the court that the complainant is entitled to the relief prayed for in her said bill, it appearing from the depositions of witnesses that the said defendant comiited adultery within the part five years and that it was not committed by the procurement or connivance of the said complainant and that the said parties have not volunarily cohabited together since the knowledge of the said acts of adultery, and that the said complainant has been domiciled in and has been an actual bona fide resident of the City of Portsmouth, State of Virginia, for at least one year preceding the commencement of this suit, and that said parties last cohabited as man and wife, in said city of Portsmouth. It is, therefore, adjudged, ordered and decreed that the said complainant, Ruth Rebecca Cassell, and the said defendant, John Edwin Wadsworth Cassell, be divorced from each other from the bonds of matrimony, and the marriage heretofore celebrated is hereby dissolved; and that all property now owned or hereafter acquired by the said complainant shall be held by her free from all marital claims of her said husband, John Edwin Wadsworth Cassell; and that all property now owned or hereafter acquired by the said defendant, John Edwin Wadsworth Cassell, shall be held by him free from all marital claims of his said wife, Ruth Rebecca Cassell, except the cost of this proceeding hereafter mentioned. Johns, of 953 North street, Park View, was struck by a Seaboard Air Line Railway passenger train at Bower's Hill at 8:40 o'clock yesterday morning and was instantly killed. Miss Johns was a teacher in the public school at Bower's Hill and was on her way from her boarding place, in the home of C. S. Warren to the school, when she was killed. Justice Duke conducted an inquest in his office at 8 o'clock last night. A verdict that Miss Johns came to her death by being struck by a Seaboard Air Line Railway train on a public crossing at Bower's Hill was returned. Advised Not To Cross--From what could be learned reguarding the accident, Miss Johns was walking from the Warren home, on the North side of the Seaboard tracks, and was apparently hurrying to join persons on the south side of the tracks. It was stated that she was warned by a youth that she could not cross the tracks before the train, which was approaching, reached the crossing. She was hurled aside by the locomotive as it passed through Bower's Hill without stopping. When witnesses of the accident reached her, she was dead. Apparently the crew of the locomotive did not see the accident for the train continued on to the city. Part of Miss Johns' lunch, which she carried with her, was strewn on the locomotive when it reached the city. Funeral Service Tomorrow--The body was brought to the city and conveyed to the funeral apartments of Flynn and O'Connor, 316 Court street, where it will remain until tomorrow afternoon, when it will be conveyed to Oak Grove Cemetery, where funeral service will be conducted at the grave at 4 o'clock. Cassell, 78, Ex-Judge of Portsmouth Portsmouth--William Hazzard Wigg Cassell, 78, of 108 London St., former judge of Portsmouth Juvenile and Domestic Relations Court, died Thursday at 11 a.m. in a nursing home. A native of Portsmouth, Judge Cassell was a son of Norman Cassell and Mrs. Virginia Stevens Wigg Cassell. He never married. He received his elementary education at the old Norfolk Academy on Bank Street and was a graduate of the University of Virginia and its Law School. He was a member of Trinity Episcopal Church and a Navy veteran of World War 1. He was a member of the Virginia House of Delegates for Portsmouth in the 1950s. He was the assistant of Judge William H. Oast, judge of the Portsmouth Municipal Court, from 1943 to 1954. Upon Judge Oast's death he was appointed in his place. The Municipal Court at that time embraced the jurisdiction of the juvenile and domestic relations activities of the Portsmouth city government. Judge Cassell was a member of the Norfolk-Portsmouth Bar Association and a past post commander of American Legion Post 7 of Portsmouth. He is survived by a sister, Mrs. Chalres Sharp Wilcox Sr.; two nephews, Charles Sharp Wilcox Jr., and Norman Cassell Wilcox; and a niece, Mrs. Daniel L. Bailey, all of Norfolk.
